酒駕犯罪之脈絡與歷程之研究

  酒駕為全球關注的社會問題,儘管酒駕是造成全球死亡率和致病率第三大危險因子,且影響甚鉅,但飲酒問題仍未完全受到重視的公共衛生議題。由於高再犯率與犯罪件數,酒駕犯罪向為台灣犯罪學研究與刑事司法體系的重要議題。本研究主要目的在透過質性深度訪談,以探究酒駕犯罪行為與犯罪者之內在與外在特性和脈絡,比較酒駕犯罪脈絡與歷程之性別差異,運用自我控制理論、日常活動理論和社會學習理論解釋酒駕犯罪之歷程,並根據研究結果探討研究結果之理論與政策意涵。本研究採取質性深度訪談與合目的配額取樣法進行個案資料蒐集,研究樣本為4位男性和4位女性於臺中監獄、臺中看守所和臺中女子監因酒駕犯罪而入監執行之受刑人(含肇事與位肇事

者)。  研究發現:(1) 多數(5/8)酒駕受刑人曾遭遇過負面生活事件,女性酒駕受刑人會因為負面生活事件而飲酒來宣洩情緒或麻痺自己對負面生活事件的感覺;相對的,男性酒駕受刑人在上班時間於工作地點喝酒,有時也因為社交活動飲酒。(2) 酒駕受刑人常忘記或忽略酒駕是違法的行為而酒駕,抑或抱持著僥倖態度,認為不會被警察發現。(3) 酒駕的誘因包括飲酒地點和家/或飲酒者要去的目的地距離不遠,為圖方便而自行駕車而非坐計程車或大眾運輸工具。(4)犯罪時情境大都缺乏監控(如:一起飲酒的朋友、無酒駕攔檢站、巡邏車少經過)。(5)自我控制理論可解釋重複酒駕,社會學習理論可解釋飲酒行為的起始和對酒駕犯罪與執法的態

度,而日常活動理論則可解釋酒駕行為的發展情境。 根據研究結果,本研究提出有關酒駕犯罪者治療、處遇、再犯預防與未來研究相關建議,如(1)DUI犯罪者治療觀點;(2)生活型態的改變;(3)酒駕情境監控;(4)酒駕犯罪者處遇重點;以及(5)整體政策方向等。
