近十年來國內出現日照權紛爭，例如：高雄澄湖園、金山南路口都市更新案等皆受到周遭住民投訴，而走上法院，雖然屢屢敗訴，但也奠定了民眾對於日照的重視，當日照不足時，人們居住品質連帶受影響，進而影響不動產價值，但其價值應如何評估還未有一套評估標準，因此本研究透過文獻分析具有較完善日照保障制度之日本，以及深度訪談法探討我國評估日照阻礙之不動產其估價方法可行性。實證結果發現，有學者認為可以運用三大估價方法評估日照阻礙對於不動產價值之差異，主要以日照所遮擋到的地方為參考因素，且在實務上會以比較法為優先，其次為收益法，成本法基本上不會採用，但因我國案例較少，因此在比較法上會採用問卷的方式進行，但對於講求效率

之估價師，較為耗時，最後本研究建議擬定有關日照補償率之標準，供我國日後評估不動產之參考。
