近年來,一種名為「平台經濟」的新興商業模式伴隨著科技的高度發展席捲全球。相較於典型之工作,此種新興經濟模式具有工作內容簡單、工時彈性、報酬即時性的特性,儼然創造了多元且門檻極低的就業機會,因而吸引了大量的勞務提供者的投入。平台經濟之興起一方面提供了企業與勞務提供者組織勞動力的全新方式,一方面卻也對既有勞動規制體系帶來衝擊。平台下不具備人格上從屬性之工作者,可能落入我國法下所謂自營作業者之範疇。本文於前段分析平台下自營作業者處境與保護需求,並透過檢視自營作業者有何等勞動與社會保障規範得以援用,進而歸納整理出現行法保護不足之處。針對平台勞動者保護不足之困境,歐陸國家即發展出創設第三類中間勞動類型

之立法模式,其中西班牙於2007年訂立自營作業者法,乃屬歐盟中首就自營作業者有系統地訂立專法之國家。本文乃以國際勞工組織以及西班牙自營作業者法等作為參考對象,就其等設立基礎、法制體例以及施行成效進行分析。期能結合多國平台治理與監管經驗,針對如何對平台中經濟上從屬工作者提供保護,以及應納入保障範圍提出具體建議,以供我國未來修法或政策擬定參酌。

近10年工作場所重大職業災害導致死亡,以災害類型區別發現墜落發生最多,其中以屋頂為媒介物的件數為甚,此類職業災害更是居高不下,為此勞動部職業安全衛生署亦不斷修正相關屋頂作業之規定及其他行政作為。屋頂作業之特性具高風險且參照職業安全衛生法相關規定即能使其危害預防達到高度之果效,然是項作業別經常非為交付承攬之事業單位所屬事業一部分或經常性工作,為探究屋頂作業災害頻傳本質因素,以達到相關作業事前之減災預防目的及從事屋頂作業相關災後之自營作業者職災保護。本文透過文獻回顧、法令規定、學者見解、相關判決整理及涵蓋行政單位、相關產業單位、學術單位、自營作業者、罹災者家屬以獲得目前實務樣態,進一步瞭解產官學

對於製造業廠房將廠房屋頂作業交付承攬予自然人相關見解,反思現行制度及相關規定中「加強職業安全衛生法第二十六條及第二十七條檢查注意事項」之法律效果適切性,並對於屋頂作業中事業單位與自然人承攬之間權責合理分配、原事業單位認定與否成為交付承攬型態職災論責破口,職業安全衛生法第51條自營作業者準用之規定所增加之權利義務及自營作業者職災保護措施,並以此試圖導出相關建議以期達到減災及對自營作業者職災保護。
