我國法以勞動基準法（下稱勞基法）第11條等規範所定事由，限制雇主解僱權之行使。另外，在我國學界與法院實務中，亦發展出有關終止勞動契約之理論與解僱保護之原理原則，其中解僱最後手段性原則為我國解僱保護法制中，最重要之一環，該原則要求雇主終止勞動契約前，必須先採取勞基法上保護勞工之規定，亦即其他對勞工權益侵害較輕微之手段，除非已經別無選擇，於不得已之情況下，雇主始得終止勞動契約。由於勞基法第11條第4款解僱事由條文中含有「無適當工作可供安置」之要件，故安置勞工至適當工作普遍被視為雇主應採取之一種迴避解僱之手段。在法院判決中該要件被廣泛討論，尤其是在不同解僱事由上之適用、適用之範圍與審查標準等問題。

本文以「無適當工作可供安置」之要件為核心，進行法院判決之實證研究。另外，本文也對企業界進行質性訪談研究，藉此瞭解企業實務落實安置之流程與操作方式，並且比較法院見解與企業運作之差距，作為未來司法實務或企業法遵之參考。
