我國自民國88年4月增訂刑法第185條之4之肇事逃逸罪以來,已22年有餘,並於102年6月修法提高肇事逃逸罪之法定刑。但從肇事逃逸罪之法條構成要件來看,係規定「駕駛動力交通工具肇事,致人於死傷而逃逸者」,條文規定的很簡單,但也就因為如此,才導致自88年肇事逃逸罪增訂以來,學說及實務對該罪之保護法益、構成要件及102年修法提高法定刑的問題,一直爭論不休。而學說及實務所爭論的問題究竟是什麼?爭論的是該罪的保護法益究竟是公共安全或者被害人生命、身體或兼顧公共安全與被害人生命、身體、或協助確認事故與責任歸屬或民事求償權或道德規範及善良風俗等。及爭論何謂「肇事」?又若因駕駛人之故意行為所致之事故,是否

前言:自2019年12月起中國湖北武漢市發現不明原因肺炎群聚起,此疫情隨後迅速在中國其他省市與世界各地擴散。結至2022年初全球累積確診病例達4億5千萬人,死亡人數近6百萬人;而寶島台灣自難免於被波及到這病毒的毒害,累積確診人數近2萬人,而死亡人數也累積到8百多人。雖然新冠肺炎對台灣的影響遠低於世界其他國家,但是對各行各業也造成莫大的衝擊,人民的生活作息型態也被迫改變;當今,牙科在台灣的發展、健保的實施下,大部分民眾已經習慣會規律的到牙科做口腔檢查,以便能早期的發現問題,早期治療;但是因為新冠肺炎疫情的爆發,打斷了此規律;所以,本研究想探討牙科病患在新冠肺炎疫情籠罩之下,面對到牙科診所治療牙

齒的態度影響為何?方法:本研究使用Google表單設計問卷內容後製作成QR CODE碼,分別在三家牙醫診所從109年9月1日開始到12月31日為止,讓前來就診的病人或陪同人員透過手機掃碼、填寫問卷、上傳回覆。收集表單後用描述性統計,使用Microsoft office軟體來呈現結果。結果:本次收集有效問卷總共400份。從回覆的問卷中可以清楚的知道會來牙科的民眾以女性居多(63%),而且有80%的民眾已經打過新冠肺炎疫苗;雖然疫情剛開始的時候不敢去牙科治療(57%),而且大多民眾(73%)會擔心打完疫苗後會有不良反應,可是有77%的民眾認為接種完疫苗,才會安心來診所,所以從疫苗開放接種後,治療的

重心又重新回到牙齒的例行檢查(57%);在政府防疫政策下,民眾出門一律配戴口罩外,66%的民眾出門會再帶酒精或消毒液,對於會接觸到的物品或接觸完物品後的雙手進行消毒。在就醫時,有91%的民眾會在意牙醫師是否有戴口罩、44%的民眾會在意牙醫師是否有戴護目鏡或面罩;84%的民眾會在意跟診助理是否有戴口罩,但是在牙醫師、跟診助理是否有穿隔離衣就沒那麼重視了。在疫情肆虐的壓力之下,78%的民眾會在意看診前,牙科椅是否有消毒過;而且想儘快的把療程結束77%。結論:在本研究中可以發現,新冠肺炎的疫情,確實影響了病人來牙科就診的態度。本問卷是在台灣疫情爆發一年九個月後才調查,而且是敢到診所就醫或陪診的民眾;

而這些民眾的回覆中還是有53%的人在疫情剛爆發時除非牙痛才會來牙科診所就醫;而且本問卷中,來診所就醫的民眾中平均有41%的人距離上次看牙超過六個月以上。由此可推斷應該有更高比例的民眾,在疫情剛爆發的當下,不敢到牙科診所治療。雖然平均有74%的民眾會擔心打完疫苗身體會有不良反應,但是,平均77%的民眾卻覺得有打疫苗去看診才會安心;再者,87%的民眾還是喜歡在住家附近看診,以方便就醫為主。本問卷的回覆裡面,有平均80%的民眾已經打了新冠肺炎疫苗。代表絕大部分的民眾還是打了疫苗之後才敢來牙科治療牙齒。66%的民眾出門會隨身攜帶酒精或消毒液,13%的民眾還會戴上護目鏡或面罩出門,少數5%的民眾甚至出門

會戴手套避免接觸任何東西。診所的選擇,還是以就醫方便的方式為主(平均41%),並不會跨區去外縣市治療。疫情爆發之後,所有的牙醫診所都會再加強診所內的感染控制;而有78%的民眾會在意看診前,治療椅有無先消毒過。有91%的民眾會在意牙醫師有無戴口罩,44%的民眾會在意牙醫師有無戴護目鏡或面罩,39%的民眾會在意牙醫師有無穿隔離衣;84%的民眾會在意跟診助理有無戴口罩,38%的民眾會在意跟診助理有無戴護目鏡或面罩,33%的民眾會在意跟診助理有無穿隔離衣;比起對牙醫師,對跟診助理的防護要求是比較低的。其實民眾擔心的是,牙醫師一天下來看了那麼多的病人,會不會無意間看過得新冠肺炎的人,然後再傳染給他(她)
