現如今為一網際網路高度發展的社會,人們使用電腦、手機與平板上網可謂稀鬆平常,平台經濟逐漸發展出來,外送平台為平台經濟整體的一環,平台業者藉由將資源整合加以利用,將效益達到最大化,提供平台當作媒介,使特定資源的供給者與需求者得以順利達到媒合,這類新型經濟型態運作下,勢必跳脫傳統經濟模式的框架下,那傳統上之法律關係是否仍有其適用?本文欲藉由此論文來加以深入平台模式下所會產生的各種民事法律關係。外送員是否為外送平台之勞工,這個問題因為前些時日發生的車禍問題逐漸浮出檯面,所有問題都牽涉於平台經濟這種經濟模式,傳統勞工之定義與勞動法規之保障是否對於外送員有相關之規範,平台經濟亦為從歐美許多國家先後發展

下,逐漸衍伸至全球,藉由比較法上研究美國法上勞動關係判斷方式與加州法上對於外送平台與外送員之AB5法案探討,佐以德國法上勞動關係之標準與因應此種外送平台模式中,創設出準勞工之立法模式加以規範,最後回到我國實務上與學說上對於勞動關係發展,並且是否對於我國法上有參考外國法上制度之必要來做檢討。最後針對外送平台經濟模式下,仍不失為我國消保法上規範的通訊交易,立法者保障消費者之方式不外乎為無條件解約權之行使與業者資訊提供義務,但於外送平台模式下須注意到主管機關有頒布通訊交易解除權例外規定與「以通訊交易方式訂定之食品或餐飲服務定型化契約應記載及不得記載事項」,另外有無排除無條件解約權和重要資訊提供之義務
